Provisions on insurance coverage for event cancellation

In addition to the present provisions, the Contingency Terms of the Eberhard, Raith & Partner GmbH (last updated 02.03.2015) shall also apply as an ancillary source.
The following provisions shall apply to insurance coverage for event cancellation:
Insured Risk
Event cancellation insurance for promoters of concerts and music events of the portal www.gigmit.com
Type A Coverage (Basic Coverage): Fees
This type of coverage provides insurance against the non-feasibility of an event because of any occurrence which lies beyond the control of the promoter, or of any contractual party employed by the promoter for the execution of the event (for example: a fire at the venue, a burst pipe at the location, a power cut). This coverage does not provide insurance coverage for failure to appear.
Type CII Coverage (Basic coverage): Costs
This type of coverage provides insurance against the non-feasibility of an event because of any occurrence which lies beyond the control of the insured person, of the promoter, or of any contractual party employed by the promoter for the execution of the event. This includes coverage against an insured person’s failure to appear, if that is caused by any occurrence which lies beyond the control of the insured person, of the promoter, or of any contractual party employed by the promoter for the execution of the event.
Insurance sum
The maximum insurance amount is 2000 € per event. This includes a maximum of € 1000 for the agreed upon artist fee and € 1000 for any further verifiable costs. The insurance amount for costs is fixed.
Registration/Waiting period
The waiting period for the registration of an event is at least 3 weeks.
Claims
In the event of a claim, the insured person (the promoter) must provide proof of the fee as well as of all incurred costs. In the event of a health problem regarding the artist, a medical certificate must be provided.
Exeptions
Type CII coverage and insurance for failure to appear do not cover any pre-existing conditions which were previously known to the insured artist. Insurance provides coverage for all new conditions, as long as they are in no way connected to any potential pre-existing conditions.
